Rutledge Borough Work Session, August 23, 2010

Diane McGaughey, Council Vice President, opened the scheduled Work Session Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.
The following Council Members answered roll call: Diane McGaughey, Tom Kopp, Jack Borsch, Kurt Morrison, and David Waltz
Also present: G. Guy Smith, Solicitor Jerry Connelly, Morton-Rutledge Fire Co.
Not Present: Brian Costello, Greg Lebold, Mayor Scott Shields

Jack Borsch needs wording for the plaque for the dogwood tree to be planted in memory of Ed McGaughey.

Jerry Connelly distributed the 2011 Morton-Rutledge Fire Co. budget – Rutledge to pay $18,175.00 for fire protection in 2011, with Workers Comp insurance added to that number.
Discussed a written agreement with the Morton-Rutledge Fire Co. Morton Borough will sign one but will not pay its Solicitor to compose one. Solicitor Smith asked Council members what they’d like in the agreement. Discussed a basic agreement to split costs 25%/75%. Workers Comp insurance will be split the same way.
Rutledge’s fire truck is listed for sale for $30,000.00.

Tom Kopp reported that there was a shed fire because someone filled a lawn mower with gas while it was hot. 17 men responded to the fire.

Solicitor Smith reported that the Tax Collector had inquired about tax forgiveness on the 10% penalty provision. The Borough Solicitor is not the solicitor for the Tax Collector. The duty of the tax collector is to collect taxes. The Borough sets the requirements for tax collection, and the Tax Collector must fulfill the obligations that the Borough has required. The Tax Collector does not have the authority to give anyone tax forgiveness.

David Waltz reported that a house on the 100 block of Rutledge Ave. put asphalt over the sidewalk when redoing the driveway, and this is not allowed.

Discussed road repairs. Diane McGaughey suggested that all of Swarthmore Ave. be repaired. David Waltz said the County should pay for Swarthmore Ave. repairs. Kurt Morrison stated it is his opinion that the Borough cannot afford to pay for the loan, and suggested that the Borough do what is needed to get by. David Waltz suggested borrowing $54,000.00 rather than $150,000.00. The Secretary stated that there is $7,425.00 available from County aid for road repairs. The Borough has carried over its allotment of $1,485.00 per year for five years. If the Borough does not use the money in 2010, 3 years of the money will be forfeited. There is approximately $9,500.00 available in the Gas Fund for road repairs. Mr. Waltz stated that it should not be used and held for emergencies. The Capital Reserve Account is used for emergencies.

Discussed the trash disposal fee. The tonnage from January 2010 to July 2010 has gone down from that time period in 2009, but the fee charged by the County has gone up, so the net is an increase in funds expended.

Mr. Waltz stated that he is working with Ridley Park regarding the heroin presentation.

Diane McGaughey stated that folder from DELCORA regarding Inflow and Infiltration from private Sewer laterals and a flyer for the Community Wide Yard Sale will be delivered to residents.
Since there was no further business, the meeting was adjourned at 8:58 PM.
