Greg Lebold, Council President, opened the scheduled Borough Council Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.
After the salute to the flag, the following Council members answered roll call: Greg Lebold, Tom Kopp, Thomas Ash, Jack Borsch, and Kurt Morrison.

Minutes: MOTION by Jack Borsch, Second by Kurt Morrison, to approve the minutes as submitted for the Council Meeting of January 5, 2009. The January 26, 2009 Work Session was cancelled due to a lack of Quorum. MOTION approved unanimously.
Public Comment: Bob Hunt, 209 Linden Ave., reported that the Girls’ Club Softball Team wants to build up the club to three teams. The Club would like to have a port-a potty at the park again this year. Mr. Hunt stated that he is working on possible grant money for the Girls Club to work on the baseball field. He will work with Kurt Morrison on it.
Paul Mecouch, 34 Linden Ave., stated that he is concerned about snow plowing because the snow is piled in the street where sun can’t get to it to melt it, and Linen & Morton Aves. are a mess. Greg Lebold stated that Catania Engineering is looking into the problem at the intersection for the point of origin. They thought it was a water main break, but the survey says it’s not. Milling the area will make a rough surface that will impede water flow.
Tax Collector’s Report: Leonard Michael reported that $19.03 was collected for 2008 taxes. Mr. Michael gave the delinquent sewer and trash fees to Greg Lebold. The Solicitor will send out letters. Delinquent general millage and per capita taxes to the appropriate parties.
Treasurer’s Report – Gennifer Guiliano distributed the Cash Flow report for the month of January 2009.
Code Enforcement/Building Inspector Reports – Greg Lebold read the Code Enforcement Report for January:
One non-traffic citation pending – court case rescheduled to February 12, 2009- property maintenance issues.
During the winter months, snow and ice must be removed form the sidewalk 24 hours after the snow has stopped falling, or a citation will be issued.
Mayor’s Report – Scott Shields read the Police Report for January 2009.
There were: 13 Parking Tickets, 12 Police Calls, 7 Complaints, 2 Assist Ambulance, 3 Motor Vehicle Citations.

Mayor Shields reported that the Delaware County Council is compiling a list of projects to be submitted for the Economic Stimulus Package. Road repair is one of the projects that are on the list.

Committee Reports:
Communication– Jean Lenke reported that the newsletter was delayed in publication. The new Borough website is being written from scratch, and the committee hopes to have it up in a month. The address is: rutledgepa.org.
Ordinance/ Trash – Nothing to report
Building – Nothing to report.
Sewer– Jack Borsch reported that he is waiting for a date for Duke’s Root Control to treat the sewer main in the 100 block between President & Linden Aves. The Solicitor needs to send a letter to the resident at 114 President Ave. to remove an elm tree that is on the Borough’s sewer main, and raise the vent pipe to 6 inches.
Shade Tree – There will be a Flea market /Craft Fair to benefit the Shade Tree Committee on Saturday, March 28, 2009 at the Borough Hall. Tree will be planted in the fall.
Highway – Greg Lebold reported that the Borough’s snow plow was repaired and is ready for snowstorms.
Recreation – Kurt Morrison stated that he would like to have a field cleanup day at the Triangle Park. The Rain Garden Project at the Triangle Park has been readvertised, and we are awaiting bids.
Public Safety – Tom Kopp reported that there were: 12 alarms, with time in service 9 hours, 50 minutes and 5 drills with time in service 13 hours, 29 minutes in December, and 18 alarms, with time in service 18 hours, 19 minutes and 4 drills with time in service 10 hours, 30 minutes in January.

Solicitor’s Report: G. Guy Smith reported that a court case involving a resident parking his truck on his front lawn has been resolved; he will no longer park the truck there. There is a pending court case for 214 President Ave. regarding property maintenance issues on February 12, 2009.
Old Business : Nothing to report.
New Business: Emergency street repairs- Unity Terrace at Linden Ave.: Greg Lebold reported that Catania Engineering stated that the potholes should not be complete repairs- spot repairs until the whole street is resurfaced. Three quotes were received: Innovative Construction – $750.00; J. Taquini – $950.00; A.F. Damon – $1,100.00. MOTION by Jack Borsh, Second by Kurt Morrison, to authorize Catania Engineering to notify Innovative Construction to do the pothole repairs on Unity Terrace at Linden Ave. at a cost of $750.00. MOTION approved unanimously.

MOTION by Kurt Morrison, Second by Todd Ash, to approve payment of the bills for the month from the General Fund in the amount of $12,496.60. MOTION approved unanimously.
MOTION by Kurt Morrison, Second by Todd Ash, to approve payment of the bills for the month from the Gas Fund in the amount of $1,019.90. MOTION approved unanimously.
MOTION by Kurt Morrison, Second by Todd Ash, to approve payment of the bills for the month from the Sewer Fund in the amount of $22,136.00. MOTION approved unanimously.
