Greg Lebold, Council President, opened the scheduled Borough Council Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.
After the salute to the flag, the following Council members answered roll call: Greg Lebold, Jack Borsch, Kurt Morrison, Tom Kopp and Diane McGaughey

Public Comment: None
Minutes: MOTION by Jack Borsch, Second by Diane McGaughey, to approve the minutes as submitted for the Council Meeting of November 5, and Work Session of November 23, 2009. Diane McGaughey stated that the old records in the garage should be moved into the Borough building. Tom Kopp questioned the sentence that says ” the Fire Co. has more in reserves than the Borough”. It was stated at the Work Session. MOTION approved unanimously.
Tax Collector’s Report: Leonard Michael reported that $3,686.88 was collected in November.
Treasurer’s Report: Gennifer Guiliano distributed the Cash Flow report for the month of November 2009.
Code Enforcement Report: Harry Mirra read his report for November.

Diane McGaughey thanked Mr. Mirra for the removal of the sign on the property at Morton & Linden Aves.
Mayor’s Report: Mayor Scott Shields read the Police Report for November. There were: 1 M.V. Citations, 11 Parking Tickets, 17 Police Calls, 24 Complaints, 3 Assist Ambulance, 1 Missing Person Reported and Cancelled
Mayor Shield reported that he has been getting calls regarding the condition of 208 Linden Ave. Mayor Shields has made several appointments with Christine Cianci, daughter of the deceased homeowners, but she never shows up for them. Council has discussed petitioning the court for an administrator, and put the costs on the estate.

Shade Tree Commission: Jack Borsch reported that 11 Okami cherry trees were planted in the unit block of Sylvan Ave., and thanked everyone who helped. The trees will be tagged with the planted date and the name of the group that supplied the grant to purchase the trees. Students from Strath Haven High School helped with the planting.
Highway: Bob Hunt reported that the snow plow the Borough has is not the correct size for the truck. He can get through the winter with it, but Council should think about getting the proper plow. There is one pallet of salt in the garage.
Kurt Morrison looked into a replacement motor for the salt spreader – $200.00.
Recreation: Kurt Morrison reported that the fence at the Triangle Park, basketball court has been installed.
Public Safety: Tom Kopp reported that there were: 25 alarms, with time in service of 8 hours, 35 minutes, and 3 drills with time in service of 7 hours, 10 minutes, in October 2009.

Tom Kopp reported that there were: 18 alarms, with time in service of 7 hours, 30 minutes, and 4 drills with time in service of 12 hours, 45 minutes, in November 2009.

Mr. Kopp reported that Santa Claus will begin his ride through the Borough on 12/24/09 at 5:00 PM, beginning at Rutledge Court Apartments.
The Fire Co. will sell Christmas trees in the parking lot of Swarthmore Library, 5:00 PM – 8:00 PM weekdays, 10:00 AM – 8:00 PM on Sat, and Noon to 8:00 PM on Sun.
There will be a breakfast with Santa on Sat 12/12/09 from 9AM to Noon at the Morton Fire House. Cost is $5.00.
Finance : Nothing to report.
Solicitor’s Report – Guy Smith stated that there will be a reorganization meeting on January 4, 2010. Judge Mallon will swear the Mayor into office.
Mr. Smith stated that he needs Council approval to proceed with the matter at 208 Linden Ave.
Old Business: Nothing to report.
New Business: MOTION by Jack Borsch, Second by Kurt Morrison, to authorize the Solicitor to take legal action to require the cleaning up of the property at 208 Linden Ave., and to authorize the Council President to sign all legal documents pertaining to the matter. MOTION approved unanimously.
Public Comment: Harry Mirra asked if any decision had been made regarding the debris in the rear property at 112 Rutledge Ave. The Solicitor will contact the homeowner.
Kurt Morrison acknowledged Len Michael’s years of service as the Borough’s Tax Collector. He thanked Mr. Michael for his efforts, and stated that he was not compensated enough for all of the hours that were put into the job.
Bills for December 7, 2009:
MOTION by Diane McGaughey, Second by Kurt Morrison, to approve payment of the bills for the month from the General Fund in the amount of $36,281.59. MOTON approved unanimously.
MOTION by Diane McGaughey, Second by Kurt Morrison, to approve payment of the bills for the month from the Gas Fund in the amount of $332.14. MOTION approved unanimously.
MOTION by Diane McGaughey, Second by Jack Borsch, to approve payment of the bills for the month from the Grant Fund in the amount of $1,690.00. MOTION approved unanimously.
